Terms of Use (ToU)

Preamble

These Terms of Use (ToU) govern access to and use of the Positive Science platform.

Positive Science SAS (being established) - 91 Route des Romains, 67200 Strasbourg, France

Use of the Platform implies full and complete acceptance of these ToU.

Article 1 – Acceptance of ToU

Use of the Platform constitutes unreserved acceptance of these ToU.

Positive Science reserves the right to modify the ToU at any time. Users will be informed by email or notification. Continued use after modification constitutes acceptance.

Article 2 – Access to the Platform

2.1. Free Access

Some parts are freely accessible: home page, presentation of journals, Open Access articles.

2.2. Access with Registration

Advanced features require an account: article submission, peer review, journal management.

2.3. Availability

Positive Science strives to keep the Platform accessible 24/7, but cannot guarantee absolute availability (maintenance, updates, force majeure).

Article 3 – Account Creation

3.1. Conditions

• Minimum 18 years old (15-18 with parental authorization)
• Accurate and up-to-date information
• One email address per account

3.2. Required Information

• Last name, first name
• Valid email
• Secure password (min. 8 characters)
• Institutional affiliation (researchers)
• Acceptance of ToU and Privacy Policy

3.3. Security

The User is responsible for the confidentiality of their credentials. Two-factor authentication (2FA) is recommended.

3.4. Account Deletion

Possible at any time via personal space or by email: [email protected]

Retention: Published articles preserved (scientific archiving), billing data (10 years - legal obligation).

Article 4 – User Obligations

4.1. Compliant Use

Use in accordance with ToU, applicable laws, third-party rights, scientific ethics.

4.2. Strict Prohibitions

Illegal Content:

• Illegal, defamatory, discriminatory content
• Violation of intellectual property
• Infringement of privacy

Scientific Fraud:

• Plagiarism, data fabrication
• Manipulation of peer review process
• Identity theft, false affiliation
• Simultaneous submission to multiple journals (unless authorized)
• Failure to disclose conflicts of interest

Technical Attacks:

• Unauthorized access, hacking
• Viruses, malware
• Unauthorized robots, scrapers
• Platform overload (DDoS)

Unauthorized Commercial Uses:

• Resale of access or content
• Massive data extraction

Article 5 – Published Content

5.1. Responsibility

The User is solely responsible for the content they publish. They guarantee having the necessary rights and respecting third-party rights.

5.2. Intellectual Property

The User retains their rights to their content.

License granted to Positive Science: Non-exclusive, worldwide, free, to host, distribute, index and archive content.

Creative Commons: For Open Access articles, the User chooses the applicable CC license.

5.3. Moderation

Positive Science may remove any manifestly illegal content or content violating ToU, after notification to the User (except in urgent cases).

Article 6 – Platform Ownership

6.1. Reserved Rights

The Platform (design, code, trademarks) is protected by intellectual property law. All rights reserved to Positive Science SAS.

6.2. Authorized Use

Personal, non-exclusive and non-transferable right of use, limited to: consultation, use of features, download for personal use.

6.3. Citation

The User may cite public content by mentioning the source, author and a link to the original content.

Article 7 – Specific Services

7.1. Article Submission

Authors submit their articles to hosted journals. They guarantee originality, data authenticity and declare conflicts of interest.

Editorial Decisions: Made by journal editorial boards, independently of Positive Science.

7.2. Peer Review

Reviewers commit to:

• Respect confidentiality
• Be impartial and declare conflicts of interest
• Respect deadlines

7.3. Journal Management

Editors have tools to manage submissions, reviewers, publications. Each journal maintains its editorial independence.

7.4. Content Access

• Open Access: Free according to CC licenses
• Restricted Access: Subscriptions, one-time payment, partner institutions
• Paid Services: See ToS

Article 8 – Responsibilities

8.1. Responsibility of Positive Science

Best efforts obligation. Positive Science does not guarantee absolute availability or absence of errors.

As a host, Positive Science is not responsible for content published by Users.

Limitations: No responsibility for indirect damages, editorial decisions, third-party links, force majeure.

Liability limited to the amount paid by the User over the last 12 months.

8.2. User Responsibility

The User is responsible for their use, their content and compliance with ToU. They indemnify Positive Science for any damages resulting from a violation.

Article 9 – Sanctions

In case of violation of ToU: warning, temporary suspension, account deletion, content removal, access ban.

Serious cases (fraud, hacking, illegal content): immediate suspension, complaint, notification to institutions.

Article 10 – Personal Data and Cookies

The processing of personal data is governed by our Privacy Policy.

Article 11 – Termination

By the User

Account deletion at any time. Published articles preserved (scientific archiving).

By Positive Science

Termination possible in case of serious violation, fraud, inactivity (3 years). Prior notice of 30 days (except in serious cases).

Mediation (consumers)

Jurisdiction

In case of unresolved dispute: competent courts of Strasbourg (France). For consumers: courts of place of residence.

Applicable law: French law

Article 13 – General Provisions

Partial Nullity

If a provision is invalid, the others remain in force.

Force Majeure

Positive Science is not responsible in case of force majeure (catastrophes, war, cyberattacks, government decisions).

Language

French version prevails.
